Privacy Policy

Protecting your private information is a priority!

  This privacy policy (“Privacy Policy”), effective January 16, 2023, pertains to Sarah Mitchell Yoga (“SMY”), a sole proprietorship, and applies to SMY’s presence on e-mail, Facebook, Facebook Messenger and Instagram, as well as SMY’s website – sarahmitchell.yoga (“Online Resources”). Because SMY collects data from persons using the aforementioned Online Resources, this Privacy Policy is designed for the benefit those users (herein referred to as “You” or “Your”).

Collection of Personal Information

In order to better provide You with services, SMY may collect personally identifiable information (collectively “Information”), including but not limited to:  

  • First and Last Names

  • Mailing Address

  • E-mail Address

  • Phone Number

  • Emergency Contact

  • Medical History    

  • COVID History

If You purchase SMY's services, SMY also collects billing and credit card information in order to complete the purchase transaction.

SMY does not collect any Information about You unless You voluntarily provide it to SMY.  However, You may be required to provide certain Information to SMY when You elect to use some of SMY’s services. Services that may require You to provide Information to SMY include, but are not limited to: (1) registering for an account on sarahmitchell.yoga; (2) sending a message to SMY via phone, e-mail, Facebook, Facebook Messenger or Instagram; (3) using the “Book a Session” scheduling function on sarahmitchell.yoga; (4) submitting Your credit card or other payment information when purchasing services; and/or (5) participating in online or in-person classes hosted, taught or published by SMY.  SMY may use Your Information to communicate with You in relation to services You have requested from SMY, as well as for general communications related to promotion and marketing of SMY’s services to You and/or the general public.  SMY may also choose to gather additional personal and/or non-personal information in the future.

Use of Personal Information

SMY collects and uses Your Information to assist in operating SMY’s business and to deliver to You the services You have requested from SMY.  SMY may also use Your Information to inform You of other services and offerings available from SMY and its affiliates.

Sharing Information with Third Parties

SMY does not sell, rent or lease its customer lists to third parties.  SMY may share Your Information with trusted partners for certain purposes, including but not limited to sending You e-mail, postal mail or other online or print communications; providing customer support; and/or arranging for in-person services. All such trusted third parties are prohibited from using Your Information except to provide services to or in conjunction with SMY, and they are required to maintain the confidentiality of Your Information.

SMY may disclose Your Information, without notice, if required to do so by law or in the good faith belief that such action is reasonably necessary to (1) conform to the edicts of the law or comply with legal process served on SMY, its owners, agents, attorneys, insurers, or affiliates; (2) protect and defend the rights or property of SMY; and/or (3) act under exigent circumstances to protect the personal safety of SMY’s owners, agents, attorneys, insurers, affiliates, users, customers or students, or to protect the safety of the public.

Right to Deletion

Subject to the exceptions set forth below, on receipt of a verifiable request from You, SMY will:

  • Delete Your Information from SMY’s records, and

  • Direct any third parties to delete Your Information from their records.

Please note that SMY may not be able to comply with requests to delete Your Information if the Information is relevant or necessary to:

  • Complete the transaction for which the Information was collected;

  • Fulfill the terms of a written warranty or product recall conducted in accordance with federal law;

  • Provide a good or service requested by You, or reasonably anticipated within the context of SMY’s ongoing business relationship with You, or otherwise perform a contract between You and SMY;

  • Detect, investigate and/or resolve online security incidents;

  • Protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for that activity;

  • Debug to identify and repair errors that impair existing intended functionality;

  • Exercise free speech, or ensure the right of another consumer to exercise free speech, or exercise another right provided for by law;

  • Comply with the California Electronic Communications Privacy Act;

  • Engage in public or peer-reviewed scientific, historical or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when SMY’s deletion of the Information is likely to render impossible or seriously impair the achievement of such research, provided SMY has obtained Your informed consent; 

  • Comply with an existing, prospective or anticipated legal obligation;

  • Protect or safeguard SMY’s legal or contractual rights; or

  • Serve the internal business or legal interests of SMY in a lawful manner that is compatible with the context in which You provided the Information.

Children under Thirteen

SMY does not knowingly collect Information from children under the age of thirteen. If You are under the age of thirteen, You must ask Your parent or guardian for permission to submit Information to SMY via any means, including but not limited to submission to SMY via phone or SMY’s Online Resources. 

E-mail Communications

From time to time, SMY may contact You via e-mail for purposes of providing announcements; promotional offers; surveys; alerts; confirmations; rescheduling or cancellation details; information related to SMY’s business; information regarding Your appointments and/or services; and/or other communications. In order to improve SMY’s services, SMY may receive a notification when You open an e-mail from SMY or click on a link in such an e-mail.

Modifications to Privacy Policy

SMY reserves the right to modify this Privacy Policy from time to time.  In the event of modification(s) to this Privacy Policy that reflect any significant change(s) in the way SMY treats Information, SMY will notify You by one or more of the following methods: (1) sending a notice to the primary e-mail address specified in Your sarahmitchell.yoga account or to another e-mail address supplied by You to SMY via any means; (2) by placing a prominent notice on one or more of SMY’s Online Resources; and/or (3) by updating this Privacy Policy. Your continued use of SMY services available after such modifications and notice will constitute Your: (A) acknowledgment of the modified Privacy Policy, and (B) agreement to abide and be bound by that modified Privacy Policy.
